Delaware Real Estate Contract & Forms for Selling Your Home

Selling a home in Delaware

Real Estate in Delaware

By virtue of its splendid location and the abundance of activities available to its citizens, properties in Delaware are very much desired. Who wouldn’t want to be living in a historically-rich State that boasts of having 24.5 miles of sandy beaches and mild, temperate weather all-year round? As such, if you plan on selling your home in Delaware, you are sure that there won’t be a dearth of interested buyers.

With an Agent, or Without

When selling a property, you have the option of going through the entire process by yourself or with the help of a real estate agent (or realtor). Each has its pros and cons and it’s really up to you to decide which you deem would be most convenient for you and your family. Basically, the real benefit clients get from working with agents is that the agents handle all the paper work and all the leg work. If you feel that you’re up to the challenge and would want to be more “hands on” in the entire selling process, you are more than able to handle everything by yourself.

Real Estate Forms

One thing you should remember about selling real estate properties is that everything should be well documented. Prior to putting your house up for sale, you have to make sure that the property is free from any liens and other encumbrances. You will need to ensure that the title is clear and to do this, you may have to visit appropriate government offices in the city or town proper.

When the title is clear and government personnel, as well as bank management (if the property is under mortgage) give you the go-signal, you can then proceed with the entire selling process.

Before you can put your home up for sale, you have to make sure that you would be able to present potential buyers with all the necessary disclosure forms, particularly the Lead-Based-Paint Disclosure (as required by the federal Residential Lead-Based Paint Hazard Reduction Act of 1992).You cannot hide anything from the buyer, thus the term and practice of “caveat emptor” (let the buyer beware) does not apply to real estate transactions in Delaware, or any other State for that matter.

On your part, the most important document you should prepare is the Disclosure statement. On the part of the buyer, the most important document he will be preparing is the Offer to Purchase, in which, all his proposed conditions regarding the purchase of your home will be itemized and detailed. If you are unhappy with the conditions your buyer has proposed, you can present him with a counter offer and both parties can pass counter offers back and forth until both are satisfied with the conditions set (or one backs out). When you and your buyer reach an agreement, the final set of conditions are finalized and a Purchase Agreement is then prepared. Both parties will then be bound by this contract.

Sourcing out the Forms

One benefit of having a real estate agent is that the agent will provide you with all the forms necessary to complete your sale. However, don’t be misguided. The real estate forms you need can be obtained from other sources, such as the internet. There are various real-estate websites that provide users with all the tools they need for various kinds of real-estate transactions. There are standard forms and forms that have been formatted to comply with the requirements of specific States (thus, it won’t be hard to find a complete set of real estate forms as used in the State of Delaware). These forms can be purchased and downloaded on a piece-by-piece basis or as a complete set.

Through these sites, selling a home in Delaware (or anywhere), has become easier.
